Terms of Service

Effective April 26, 2026

These terms govern your use of PointOps. By creating an account or accessing the service, you agree to them. If you do not agree, do not use the service.

1. The service

PointOps is an operations dashboard that connects to your Mindbody site(s) and presents schedule, sales, membership, and AI-assisted briefing functionality to authorized users in your organization.

2. Eligibility and accounts

You must be at least 18 and authorized to bind the business you represent. Each user must have their own account credentials — sharing logins is prohibited. You are responsible for keeping your credentials confidential and for all activity under your account.

You retain all rights in the data you upload or that we sync from Mindbody on your behalf ("Customer Data"). You grant PointOps a limited license to use Customer Data solely to provide and improve the service for you. We act as a processor of Customer Data on your behalf — see the Data Processing Agreement.

AI features (briefings, rundowns) send Customer Data to Anthropic for inference. By enabling those features, you instruct us to do so. Anthropic does not retain prompts or responses for training under their commercial terms.

5. Subscriptions and billing

Pricing is published on pointops.io. Subscriptions renew automatically on the term you select (monthly or annual). You can cancel anytime from the in-app billing portal; the cancellation takes effect at the end of the current term and we do not pro-rate refunds for partial periods, except where required by law.

We may change pricing for new sign-ups at any time. Existing subscribers will be notified at least 30 days before any price change applies to their account.

If a payment fails we will attempt to recover it for up to 7 days. After that, your account becomes read-only until payment is resolved. After 30 days of non-payment we may delete your data per the retention policy.

6. Beta features

Features marked beta or experimental are provided as-is, may change without notice, and may be removed at any time. Don't rely on them for critical workflows.

7. Service availability

We aim for high availability but do not commit to a specific uptime SLA on the standard plan. Scheduled maintenance, third-party outages (Mindbody, Supabase, Vercel), and force majeure events may cause temporary unavailability. We are not liable for outages caused by upstream services.

8. Suspension and termination

We may suspend or terminate accounts that violate these terms, engage in abuse, or fail to pay. We will provide reasonable notice unless immediate action is needed to protect the service or other users. You can terminate your account anytime by emailing hello@pointops.io.

9. Disclaimers

The service is provided "as is" and "as available." To the fullest extent permitted by law, PointOps disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and that the service will be uninterrupted or error-free. AI-generated content (briefings, summaries) may be wrong or misleading — do not rely on it as legal, financial, medical, or professional advice.

10. Limitation of liability

To the fullest extent permitted by law, PointOps' total liability for any claim arising out of or relating to the service is limited to the greater of $100 or the fees you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenue.

11. Indemnification

You agree to indemnify PointOps from third-party claims arising out of your violation of these terms, your unlawful use of the service, or your infringement of any third party's rights via Customer Data you submit.

12. Governing law

These terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Fulton County, Georgia, and you consent to exclusive jurisdiction there.

13. Changes to these terms

We may update these terms. Material changes will be announced via in-app notification and email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
